Timber Pest Inspection Agreement

Note: In the ACT under the Civil Law (Sale of Residential Property) Act 2003 and the Civil Law (Sale of Residential Property) Regulations 2004, the report resulting from this inspection may be forwarded to the buyer as part of the sale process, provided that it is not made more than three months before registration and is not more than six months old. Client means the legal person(s) or other legal persons for which the inspection is to be carried out. By order of the representative of the person(s), it is agreed that the agent shall represent the person(s) and shall be authorized to act for and on their behalf. (See also “You/Your” below) Our/Us/Us means the company, partnership or person you have hired to perform the property inspection and report below. You/you designate the party identified as a customer under this Agreement and if more than one party has all such parties jointly, severally and individually with a representative of that party. The access hole (cover) refers to an opening in the structure to allow safe access to perform an inspection. To avoid any misunderstanding about the type of inspection we will perform and the scope of the resulting report, you must immediately read, sign and return to us the email approval of this Agreement. If you do not return the copy to us and cancel the requested inspection, you agree that this document constitutes the agreement between you and us. We will perform the inspection and report as directed by you in accordance with this Agreement and you agree to pay for the inspection and report upon delivery of the report. By ordering the inspection, you agree that the inspection will be conducted in accordance with the following clauses that define the scope and limits of the inspection and report.

Limitation refers to any factor that prevents the full achievement of the objective of the inspection. Wood pests refer to underground and wet wood termites (white ants), spicy wood drills and wood rot fungi (rot). If you do not sign and return to us a copy of this Agreement and cancel the requested inspection, you agree that you have read and understood the contents of this Agreement and that we will conduct the inspection on the basis of this Agreement and that we may rely on this Agreement. Structural inspection means that the inspection includes a visual assessment of the accessible areas of the property in order to identify significant deficiencies in the structure of the building and to form an opinion on the general condition of the structure of the property.
